Context
- Recently, the Union Government enacted the Mines and Minerals (Development and Regulation) (MMDR) Amendment Act, 2026 to create a uniform taxation framework for the mining sector.
- The Act restricts States from imposing new taxes or levies on mineral rights and mineral-bearing lands except under conditions prescribed by the Central Government.
Reason for the enactment of the Act
Different States were imposing different charges on mining. This was making minerals like coal, iron ore and critical minerals more expensive.
The government says that reducing this extra and uncertain burden will:
- Make mining cheaper and more predictable,
- Encourage investment and mining activity,
- Reduce costs for industries like steel, cement and electricity, and
- Ultimately help control costs for ordinary people.
Key Provisions of the MMDR Act
- Section 9D of the Act says that States cannot impose new taxes/levies on mineral rights or mineral-bearing land unless allowed under Central Government conditions; old unpaid levies are invalid, but already-paid amounts will not be refunded.
- Section 13 gives the Central Government power to set rules for any State-level mineral levies.
- Around 50 minor minerals such as sand, gravel, granite and marble remain fully under State control and are not affected by the Act.
