Article 16 (What is it?)
- Article 16 of the Indian Constitution guarantees equality of opportunity for all citizens in matters of public employment or appointment to any office under the State.
- It is a Fundamental Right under Part III and is an important component of the constitutional principle of equality and social justice.
Key Provisions of Article 16
1. Article 16(1) – Equality of Opportunity
- Ensures equal opportunity for all citizens in matters of public employment and appointment under the State.
- Prohibits arbitrary discrimination in recruitment and selection.
2. Article 16(2) – Prohibition of Discrimination
- No citizen can be discriminated against in public employment solely on grounds of religion, race, caste, sex, descent, place of birth, residence, or any of them.
3. Article 16(3) – Residence Requirement
- Parliament can prescribe residence requirements for certain public employment.
- This provision aims to balance national equality with regional interests.
4. Article 16(4) – Reservation for Backward Classes
- Permits reservation in public employment for backward classes of citizens that, in the State’s opinion, are not adequately represented in State services.
5. Article 16(4A) – Reservation in Promotion
- Enables reservation in promotion for SCs and STs where they are inadequately represented in State services, subject to constitutional and judicial conditions.
6. Article 16(4B) – Carry-Forward Vacancies
- Allows unfilled reserved vacancies to be carried forward and treated separately in subsequent recruitment years.
7. Article 16(5) – Religious Institutions
- Permits laws requiring the holder of an office connected with a religious or denominational institution to belong to the relevant religion or denomination.
8. Article 16(6) – EWS Reservation
- Enables reservation of up to 10% for Economically Weaker Sections (EWS) in public employment, in addition to existing reservations.
Important Supreme Court Judgments
1. Indra Sawhney Case (1992)
- Upheld reservation for OBCs under Article 16(4).
- Generally established the 50% ceiling on reservations, subject to exceptional circumstances.
- Held that reservation under Article 16(4) does not extend to promotions.
2. M. Nagaraj Case (2006)
- Upheld constitutional provisions enabling reservation in promotion for SCs/STs, subject to certain constitutional requirements.
3. Janhit Abhiyan Case (2022)
- Supreme Court upheld the 103rd Constitutional Amendment, validating EWS reservation under Article 16(6).
