  • Enrolment Oversight: Under Section 26, reviews rejected enrolment applications; its decision is final and binding.
  • Foreign Degree Recognition: Recognises foreign law degrees on a reciprocal basis; the 2023 notification restricts unrecognised foreign degrees and provides for 1–2 year bridge courses for shorter-duration degrees.

Supreme Court Oversight

  • In Mihira Sood Case Supreme Court Provided that Bar Councils cannot discipline law students; their authority begins after enrolment of the student.
  • In the National Academy of Legal Studies and Research, Hyderabad (NALSAR) Dispute Supreme Court upheld academic independence and questioned the prolonged tenure of the Bar Council of India Chairman.
  • Reforms: Directed financial scrutiny, time-bound elections and reconstitution of the Bar Council of India.

Foreign Lawyers and the All India Bar Examination

  • Foreign Lawyers (2025 Rules): May practise foreign law, international law and international commercial arbitration on a reciprocity basis, but cannot appear before Indian courts or tribunals.
  • All India Bar Examination: Introduced in 2010; passing grants the Certificate of Practice, mandatory for court practice.
